I made a suggestion to my club that we comply with the rule by creating a Notarized Statement listing the names of the wrestlers' birth certificates viewed by the Club Officers and then either handing the original documents back to the parent or guardian, or stating on the document that all copies will be destroyed using commercially reasonable security procedures. The signatures of the Club Officers should be Notarized, and the club would need to ensure any documents received by the club were indeed shredded.
I am not an attorney. I do however, work in a bank and am responsible for dealing with consumer protection laws and also regularly with customers who have been victims of various types identity theft. It is a huge problem and some of you may say, "Well, why does this matter with some 6 year-old's birth certificate?" But you would be surprised at the depths at which ID theft can occur. Something as seemingly insignificant as a child's birth certificate can be the first item needed to carry out ID theft.
I also pose a question to USAW-KS--with the relative lack of guidance to individual clubs for complying with this requirement, will USAW-KS liability insurance cover a club that fails to securely handle this information?
